The Court of Rome has accepted the collective action promoted by Movimento Consumatori, establishing that the contractual clauses used by Netflix to justify price increases over the past seven years are null. At the heart of the legal dispute is the 'abusive' nature of these conditions, which allowed the American giant to modify the costs of the Basic, Standard (including the ad-supported variant), and Premium subscriptions between 2017 and 2024.

The critical issue identified by the judges concerns the absence of a justified reason within the contract, as previously stated. According to consumer protection regulations, any unilateral variation of economic conditions must be supported by specific reasons and clearly communicated to the user, an element that in Netflix's case was deemed lacking. Consequently, millions of Italians who have seen their monthly streaming profile costs rise now claim a credit against the platform.

The economic impact of the ruling is significant: customers are entitled to receive refunds for the amounts paid in excess, with figures reaching up to 500 euros per subscriber. The refund calculation is based on the difference between the amount paid after various increases and the original price subscribed at the time of activation of the service.

In addition to the reimbursement of past payments, the Court's decision paves the way for a reduction in the current subscription price. Users would indeed have the right to see the original fee restored until the company adjusts the contracts with reasons deemed valid by law. This means that those who have kept the service active since 2017 could request a full recalculation of all billed monthly fees with the updated rates. The company must also actively inform all its customers, including those who have since canceled, about their right to receive a refund.

This is not a passive measure, but a procedure that requires the platform to send specific communications to subscribers involved in the period from 2017 to 2024. If Netflix does not proceed with the refunds spontaneously following the indications of the Court, Movimento Consumatori has already confirmed its intention to initiate a class action to force the return of the amounts unduly collected. To participate in the initiative and express their interest, users must fill out an online form provided by the association. The action aims to protect the vast audience of consumers who, despite having experienced increases of a few euros per month, have accumulated significant expenses over the years without a legitimate contractual basis.
